Though perfect reflective equilibrium is unattainable, we can use themethod of reflective equilibrium to get closer to it and soincrease the justifiability of our beliefs. In carrying through thismethod, one begins with one's considered moral judgments: those madeconsistently and without hesitation when one is under good conditionsfor thinking (e.g., “slavery is wrong,” “allcitizens are political equals”). One treats these consideredjudgments as provisional fixed points, and then starts the process ofbringing one's beliefs into relations of mutual support andexplanation as described above. Doing this inevitably brings outconflicts where, for example, a specific judgment clashes with a moregeneral conviction, or where an abstract principle cannot accommodatea particular kind of case. One proceeds by revising these beliefs asnecessary, striving always to increase the coherence of the whole.

While scholars have traditionally focused on the problems of agency capture by special interest groups, the rise of discretionary spending has raised a novel problem of agency capture by political influencers, namely Congress and the President. While Congress has acted to curtail its own credit-claiming opportunities with appropriations, Congress has not sought to prevent presidents or their appointees from abusing the delegation of congressional powers to the executive branch for political self-interest. While strategic plaintiffs and engaged courts may find a remedy to agency political capture via the Administrative Procedure Act, the Tucker Act, implied contractual duties, or constitutional theories, the need for Congress to provide additional avenues for redress is clear.
