In 2011, the supreme court declared that the state of California reduce its prison population by more than 30,000 inmates. Liptak explains that the overcrowding violates the eighth amendment by subjugating prisoners to cruel and unusual punishments. The prison system allegedly failed to provide adequate medical care for inmates with serious medical and mental health issues. Instead of dealing with problems on a case by case basis, the state appears to be more concerned with “structural injunctions” in “institutional-reform litigation.” How will this benefit the general public or the incarcerated inmates?
